ZOOMWASH KNOXVILLE, TENNESSEE – TERMS OF SERVICE & MEMBER AGREEMENT
Welcome to ZoomWash (located at 4300 Clinton Hwy, Knoxville, TN 37912). By purchasing a Single Wash, subscribing to our Monthly Unlimited Membership, purchasing a Special Event ticket, or utilizing our automated tunnel, vacuums, mat washers, or self-service interior cleaning equipment, you agree that ZoomWash, its owners, officers, directors, employees, contractors, agents, and representatives shall be legally released from liability to the fullest extent permitted by Tennessee law, and you agree to be legally bound by the following Terms of Service:
1. SERVICES & VEHICLE VALIDITY
ZoomWash provides automated exterior vehicle washing, automated vacuums, mechanical mat washers, and complimentary self-service interior cleaning supplies.
- Single Washes: Single wash tickets and digital codes are not date-restricted. They remain valid across operational days and do not expire unless explicitly sold under a specific promotional or seasonal expiration window.
- Special Events: Tickets purchased for special events (e.g., charity drives, holiday theme washes, after-hours events) are strictly limited to the specific date and hours of that event. They carry no cash value and cannot be redeemed for regular wash services.
2. MODIFIED & NON-FACTORY VEHICLE POLICY
Our automated wash tunnel is designed exclusively for standard factory-specification vehicles. Vehicles with aftermarket, custom, or non-factory alterations present severe mechanical risks to both the vehicle and our equipment.
ZoomWash operates under a zero-liability policy for any damage involving non-factory or modified vehicles. By entering the wash site, owners of the following vehicles assume 100% of all risk:
- Lifted Vehicles: Vehicles with aftermarket suspension lifts, body lifts, oversized off-road tires, or widened wheel tracks are prone to track derailment and brush entanglement.
- Squatted / Lowered Vehicles: Vehicles modified with "squatted" geometry (front lift/rear drop), lowered suspension, or altered body angles cannot safely align on our conveyor system and are strictly barred or processed at the owner’s sole risk.
- Dual-Rear-Wheel (Dually) Trucks: Dual-rear-wheel configurations exceed standard tunnel track widths. Dually trucks must receive explicit attendant clearance before entering the tunnel guide rails.
- Commercial Fleets & Vehicles: Heavy-duty commercial trucks, utility beds, ladder racks, and vehicles carrying loose commercial equipment are not covered for exterior component damage.
- Aftermarket Add-ons: We accept zero liability for damage to non-factory items, including but not limited to: aftermarket rims, custom spoilers, light bars, non-factory antennas, extended side mirrors, bike/cargo racks, or structural wraps.
3. VEHICLE DAMAGE & PROPERTY LIMITATIONS
For all standard factory vehicles, ZoomWash and its employees, managers, and on-site contractors are only liable for damage directly caused by proven gross negligence or mechanical failure of our equipment.
- Pre-Existing Damage: ZoomWash, its staff, and its contractors are not responsible for damage to components with pre-existing wear, chips, stress cracks, rust, or loose factory parts (e.g., aging trim, loose emblems, peeling clear coat).
- Self-Service Areas: Customers utilize our automated vacuums, mechanical mat washers, and interior cleaning supplies at their own risk. ZoomWash and its employees are not liable for damage to vehicle interiors, personal property vacuumed up by accident, or fabric damage from cleaning solutions.
- Loose Items: Customers must ensure all windows, sunroofs, truck beds, and tailgates are completely closed and cleared of loose items before entering the tunnel.
4. MANDATORY 24-HOUR INCIDENT REPORTING
- On-Site Filing: Any claim regarding vehicle damage alleged to have occurred on ZoomWash property must be reported to an on-site manager prior to leaving the wash premises, or formally submitted in writing within twenty-four (24) hours of the incident.
- Waiver of Claim: Failure to report an incident within this 24-hour window constitutes an absolute waiver of the claim, legally releasing ZoomWash Knoxville, Tennessee from all liability.
- Investigation: ZoomWash reserves the right to review high-definition tunnel camera footage and equipment logs to verify any claim.
5. MONTHLY UNLIMITED MEMBERSHIP TERMS
- Automatic Billing: The Unlimited Membership fee will be automatically charged to the customer’s credit or debit card on file each month on the anniversary date of enrollment.
- Cancellation Policy: Members may cancel their subscription at any time. To prevent the next automated billing cycle, cancellation requests must be processed online or in person at least five (5) days prior to the next scheduled billing date. No prorated refunds are issued for mid-cycle cancellations.
- Usage Limits: Memberships are tied strictly to a single vehicle via RFID tag or License Plate Recognition. Transferring tags or abusing fleet accounts will result in immediate termination without a refund.
- Declined Payment & Retry Policy:
- Payment Failure & Access Suspension: If your monthly recurring membership fee is declined or fails to process on your scheduled billing anniversary date, your unlimited wash membership benefits and automated tunnel access will be immediately suspended.
- Automated Retry Attempts: ZoomWash reserves the right to re-attempt charging your billing payment method on file periodically following a declined transaction (e.g., daily or at scheduled intervals over a 14-to-30-day retry window) to settle any outstanding balance and restore active membership status.
- Termination & Account Updates: If retry attempts remain unsuccessful after the billing retry window, your membership will be automatically canceled. Updating your card details online or in person will immediately re-authorize your account and resume your regular billing cycle. ZoomWash is not responsible for any bank, overdraft, or non-sufficient funds (NSF) fees assessed by your financial institution resulting from authorized retry attempts.
6. GOVERNING LAW
These Terms of Service are governed by and construed in accordance with the laws of the State of Tennessee, without regard to its conflict of law principles.
